   Today specialists of the Committee against Torture have been officially notified that the verdict against criminal investigator Sergey Biryukov from the Nizhegorodskiy district Directorate of the Interior, Nizhny Novgorod, has entered into force. On 2 April 2009 Mr. Biryukov was found guilty under cl. “a”, “b”, p.3 art. 286 of the RF CC (abuse of powers with violent treatment and use of special devices).
The court found that defendant Biryukov had acted intentionally, contrary to his duties, without an order issued by his heads and abusing his powers; at night on April 1, 2008 he got into the cell for administrative detainees where Mr. Dadashov was kept and at least ten times applied an electric shocker to the body of the detainee, thus causing him severe sufferings. The officer also kicked Emil in the lumbus area and hit him on the head with his head thus breaking three teeth of the guy.
The same results were obtained in course ofpublic investigation conducted earlier by the Interregional Committee against Torture where Mr. Dadashov had applied for help after the battery. Mr. Biryukov did not appeal against the verdict, nor did the prosecutor’s office.
The court sentenced Biryukov to 3 years of imprisonment in a standard security penal colony. Besides, he cannot work in law enforcement and public bodies for two years.
Emil Dadashov’s representatives – lawyers of the Interregional Committee against Torture who supported him throughout the process – find this judgment lawful and well-grounded. However, “Emil Dadashov’s case” will not be closed. The Committee against Torture thinks that the duty police officer should also be held liable, since only due to his negligence officer Biryukov could use violence against Mr. Dadashov.
Emil Dadshov is planning to sue the state for moral and material damages incurred by the officer’s actions.
